ASSAULT. Elizabeth Cole v. George Cole. Mr. Wrixton appeared for the plaintiff, and Mr. Rymer for the defendant. The plaintiff and defendant in this case are mother and son. On the opening of the case Mr. Wrixton requested a remand until the next court. This was agreed to by the parties, but the plaintiff wished to know if she could go to her own house to live. In answer to the bench, she said her son (the defendant) told her on Tuesday last that if she was not out of that place on the morrow he would put her out. The bench thought there was something else in the affairs, and that it would be better to hear, to which the legal men agreed. Mrs. Cole was then put in the witness-box and, in answer to Mr. Wrixon. Hinted that on Tuesday last the dependent refused to allow her to milk a cow she had, and upon her taking some hay to give to it he struck her in the face. The property belonged to her husband, who died without, making a will and she administered. The property consisted of about 20 acres of land and a number of cows and sheep. In-answer to the bench, she said she claimed all the property. The defendant was her own son. The bench remarked that she claimed more than was her own, as her children (of which she stated she had six) were entitled to a share of it. She said she only wanted what the law allowed her. Mr Rymer, in reply, stated that the plaintiff was labouring under a delusion respecting her son striking her, and, in answer to that gentleman, she stated that to her knowledge she did not transfer her property to her son. She had been to Sydney, but did not know when she went. To the bench: They lived together in one house. At this stage Mr Rymer, for the defendant, stated that he would allow her £1 per week to keep her, and she could live where she liked until the transfer or sale of her property was settled. The case was then adjourned till the next sitting of the police magistrate at Huntly, for the purpose of an amicable settlement being arrived at. The case, it appears, arose out of a disagreement respecting the sale of the property to the son, George Cole. Sometime ago the plaintiff suffered from a sunstroke, and up to the present time, to all appearances, has not regained her proper reason. It appears that before she left for Sydney she sold or made over to her son all her property, and on her return disclaimed all know ledge of the affair, and wants the property back again, hence the disagreement.
